Hampton v The Lord Chancellor and The Ministry of Justice ET/2300835/2007 an employment tribunal held that the policy of forcing the retirement of Recorders who reach the age of 65 is contrary to the Employment Equality (Age) Regulations 2006. The tribunal found that the Ministry of Justice had failed to show that the need to retire Recorders at 65 was proportionate in meeting a legitimate aim, in this case to make room for a "reasonable flow" of new appointments.
